BAXTER CO., Ark.- A Missouri man is arrested in Fulton County on Thursday in connection to the fraudulent sale of a Caterpillar Excavator.

Christopher Rhoades, 33, of Nixa, Missouri, had an outstanding bench warrant from April 9, charging him with defrauding a secured creditor and theft.

The Baxter County Sheriff’s Office obtained the warrant after looking into a complaint filed by someone who lives in the county on March 30.

The complainant said he had bought a 305E Caterpillar Excavator from Rhoades, who had listed for sale on Craigslist on November 26, 2017, for $32,800.

On March 25, 2018, a repossession company contacted the complainant saying they were repossessing the equipment for Caterpillar Company, which had a lien on the equipment that was delinquent. The lien holder was able to find the excavator using a GPS tracking device on the equipment.

The complainant told investigators he asked Rhoades if there was a lien on the equipment, and Rhoades said there was not.

According to the Caterpillar Company, there was a lien on the equipment for $36,254.96. The company says the last payment Rhoades made on the equipment was in September 2017. Two later payments were made, but the checks were returned due to insufficient funds.

After being arrested on Thursday in Fulton County, he was booked in the Baxter County jail on Defrauding a Secured Creditor and Theft of Property Charges.

Rhoades is being held on a $32,000 bond and will appear in Circuit Court on June 21.
