Cop Charged In Repo Death Seeks Self Defense Immunity

A former officer of the Decatur Police Department, now facing murder charges, has officially requested a hearing for self-defense immunity, as disclosed in court documents..

The accused, Mac Marquette, was charged with murder following the fatal shooting of Steve Perkins in September 2023. The incident occurred on September 29, 2023, outside Perkins’ residence. The altercation reportedly began after a towing company arrived at Perkins’ home to repossess his truck. Tragically, this confrontation escalated, resulting in Perkins being shot and killed.

Recently filed court documents offer insight into Marquette’s defense. According to these filings, Marquette’s legal team argues that he perceived Perkins as an immediate threat, having allegedly observed Perkins holding a firearm. The documents claim that Marquette repeatedly instructed Perkins to put down the weapon. However, as per the defense’s assertion, Marquette only discharged his firearm after Perkins pointed his gun directly at him, leaving Marquette no alternative but to act in self-defense.

A Morgan County judge has responded to this development by scheduling a self-defense immunity hearing in conjunction with Marquette’s trial, which is set to take place in April. This hearing will determine whether Marquette can avoid prosecution under the state’s self-defense laws.
