Collateral Recovery Repossession News And Directory

Pennsylvania ALPR Bill Advances To Senate From House

Pennsylvania House Bill 2771 could have a significant impact on vehicle repossessions by restricting the use of automated license plate readers (ALPR) to a narrow list of authorized purposes. The bill expressly prohibits ALPR use for personal, political or commercial purposes, and ordinary vehicle recovery is not listed as an authorized use. If applied to commercial repossession activity, this could prevent agencies from using license plate reader networks to locate vehicles subject to repossession, even when a lender has legally assigned the account for recovery.

The bill also imposes strict limits on data retention and sharing, generally requiring covered data to be deleted within 72 hours, with specific exceptions. Access to captured data would be tightly controlled, and government agencies could obtain privately captured ALPR data only under a valid, court-issued probable-cause warrant for a criminal offense. These restrictions could affect the commercial data networks and information-sharing arrangements that repossession agencies rely on to identify vehicle locations.

The biggest unanswered question is how the law’s definition of a covered “private entity” would apply to independent repossession agencies and commercial ALPR operators. The bill ties that definition to entities under contract with government agencies, creating a legal interpretation issue, but it contains no express exception for repossession work. If enacted and interpreted to cover commercial repossession-related ALPR use, the legislation could significantly limit one of the industry’s vehicle-location tools in Pennsylvania.

The bill has passed the Pennsylvania House but must still proceed through the state Senate before it can become law. Its provisions could change as the legislative process continues, and any final version would need to be approved and enacted before taking effect. For repossession agencies, the bill bears watching, but its ultimate impact will depend on the final language and how its restrictions are interpreted.
