Shots Fired During Mountain View, TN Repo

DAYTON — A Dayton man is facing several charges after he allegedly fired shots during a vehicle repossession and after investigator found marijuana in his residence, according to investigators with the Dayton Police Department.
Mikel McVay, 52, is facing the charges for his role in an incident in the Mountain View community on Tuesday, Sept. 30, according to an arrest report.
Dayton Police Department Investigator Michael Green said officers responded to reports of shots fired on Magnolia Avenue at around 6 p.m. on Sept. 30.
“Officers arrived on scene, spoke with the victim, secured the area and established a perimeter around the residence,” Green said. “After several commands, a female exited the residence and was detained. Moments later, a male party identified as Mikel McVay exited the residence and was also detained.”
Green said that the victim told him that he was at the residence to repossess a vehicle and that while he was repossessing the vehicle McVay began to shoot “what he thought was a shotgun in his direction.”
“[The victim] stated that he stuck his hands out of the window and told [McVay] that he would release the vehicle,” Green said. “[The victim] stated that he exited the vehicle and began to unhook the vehicle, but [McVay] continued to shoot in his direction at times so close that it would push debris on him.”
Green said that while investigating the scene, he found two spent shotgun shells.
Upon questioning witnesses, Green said that a witness told him that she heard gunshots and looked out her window to see McVay shooting in the air.
“[The witness] then stated that he took the gun and bullets somewhere, but he had taken some marijuana and put it in the back room,” Green said.
Dayton Police Department Investigators eventually received a warrant to search the home, where Green said they found an additional four spent shotgun shells and “loose marijuana.”
McVay was subsequently arrested and charged with two counts of aggravated assault, two counts of reckless endangerment, being a felon in possession of a firearm and the manufacture, delivery or sale of a Schedule VI controlled substance.
