Bill Proposes No Repo On Furloughed Fed Workers

Congress is considering the Federal Employee Civil Relief Act, a bill that would protect federal employees and many federal contractors from eviction, foreclosure, car repossession and certain debt actions if a government shutdown leaves them unpaid. Senate and House members have already introduced companion versions of the legislation, and it is being framed as emergency relief for people caught between Congress and their bills.

The proposed protections would last during a shutdown and for a short period afterward. During that time, affected workers would be shielded from some enforcement actions—even though the underlying debt would still exist. The goal is to prevent people from losing homes, cars or other essentials simply because federal paychecks are delayed.

Even before the law is passed, agencies in the repossession space should take proactive steps. Update your internal policies to include a protocol for handling claims of federal employment or contractor status. Establish clear verification procedures and require instructions from creditors before proceeding with actions when a claim is made. Train your staff to escalate any such claim immediately and to document everything carefully. Consult legal counsel on how to respond if conflicting or ambiguous instructions arrive.

The bottom line: this law—if enacted—won’t eliminate debts, but it would create a pause on many enforcement activities during federally induced pay disruptions. Repossession and enforcement agents should get ahead of it rather than scramble after the fact.

During a government shutdown, the act would provide for the temporary suspension of certain civil liabilities for furloughed federal workers and contractors who are working without pay.
Protections would include: 
  • Protection from evictions and foreclosures
  • Postponement of certain civil obligations, such as rent, mortgage, and tax payments
  • Protection from repossession of a car or other property
  • Deferral of federal income tax and student loan payments without penalty or interest
  • Prevention of negative credit reporting and other adverse actions by lenders or creditors
  • Prohibition against cancellation or lapse of insurance policies due to missed payments 
The Federal Employee Civil Relief Act has been introduced in both the House and Senate in recent years:
  • In October 2025, Senator Brian Schatz (D-HI) and other senators introduced the bill in the Senate. A companion bill was also expected to be introduced in the House.
  • During the 118th Congress (2023-2024), similar legislation was introduced as S. 640 in the Senate and H.R. 1301 in the House
